Box Office Guru Wrapup: The Grey Takes the Top Spot

This weekend, audiences turned out for Liam Neeson's latest thriller The Grey which topped a busy frame that saw three new action entries attack a North American box office that already had plenty of action offerings. Marking the first number one debut for rookie distributor Open Road, the R-rated Alaskan survival pic bowed to an estimated $20M from 3,185 theaters for a solid $6,279 average. Following Taken and Unknown, Neeson has emerged as a more cerebral action hero and has now anchored three number one hits over the past three years which is more than most other Hollywood stars like Robert Downey Jr., Brad Pitt, Tom Cruise, Angelina Jolie, Leonardo DiCaprio, Will Smith, Matt Damon, or Denzel Washington.

Reviews were favorable for The Grey but audiences were not too thrilled with the outcome as the wolf attack flick earned a disappointing B- grade from CinemaScore. Social media chatter on Twitter included plenty of disappointment from people who thought that Neeson would have a bigger presence in the film given his prominence in the advertising campaign. But after the shocking $24.7M debut of Taken over Super Bowl weekend in 2009 and the brawny $21.9M debut of Unknown over last year's Presidents Day holiday frame, it made sense that Neeson was far and away the top commercial selling point for the $25M production which boasted no other major stars. Coming up on his 60th birthday, the busy Irish actor could possibly star in a whopping five number one hits this year thanks to the February 10 re-release of Star Wars Episode I: The Phantom Menace, the March 30 bow of Wrath of the Titans, the May 18 launch of Battleship, and the July 20 release of The Dark Knight Rises.

Despite all the action competition, last week's box office champ Underworld: Awakening held up incredibly well dropping 51% to an estimated $12.5M for the lowest sophomore decline in the history of the four-film franchise. The first three pics each fell by 55-65% after their debuts and generally fourth chapters in a sci-fi or horror series draw such a big part of the built-in audience upfront that they crumble in the second frame. Sony has taken in $45.1M after ten days with its Kate Beckinsale vehicle and can expect a final take in the $65-70M range helped in part by 3D surcharges.

Katherine Heigl landed in third place with a respectable debut for her latest film One for the Money which bowed to an estimated $11.8M from 2,737 sites for a decent $4,293 average. Lionsgate refrained from screening the PG-13 action-comedy for critics but reviews that eventually came out were brutal making it the front-runner for next year's Razzie Awards at this early stage in the race. Heigl's films routinely open in double digit millions despite horrible reviews and lame plots although this one lacked a notable male lead. Money, which finds the actress playing a bail bondswoman hunting down an old flame, skewed heavily towards women with studio research showing that the audience was 79% female and 74% over 25. With a lackluster B- CinemaScore, the road ahead looks grim.

The fighter pilot actioner Red Tails dropped 45% from its impressive debut and took fourth place with an estimated $10.4M. Fox's release of the George Lucas production has collected $33.8M in ten days and a final tally of $55-60M seems likely which is more than most expected.

Scoring the worst opening of the frame's three new releases, but the best audience feedback, was Summit's Man on a Ledge with an estimated $8.3M. The PG-13 film averaged a weak $2,752 per theater from 2,998 locations and just couldn't compete with the wide range of other action offerings in the marketplace. Reviews were dull and lead actor Sam Worthington has never anchored an action hit outside of pre-existing brands like Clash of the Titans or James Cameron. But Ledge did have broad appeal with men and women represented equally and 56% of the crowd being under 25. The CinemaScore grade was a decent B+ and the Friday-to-Saturday increase was 44% - both tops among the freshmen.

A pair of Oscar nominees for Best Picture followed, each exploiting the nominations in a different way. The Tom Hanks-Sandra Bullock drama Extremely Loud & Incredibly Close dipped only 29% to an estimated $7.1M in its second weekend of wide release to raise the cume to $21.1M. Warner Bros. has used a Million Dollar Baby-style strategy with this 9/11 pic by opening in just a small number of theaters in late December in order to qualify and then waiting until nomination time to go nationwide letting others duke it out during awards season in hopes that it will be a fresh new option for voters and mainstream audiences alike. The plan worked for Baby which triumphed over the presumed front-runner The Aviator that year. But it may not be repeat this time as Loud only scored one other Academy Award nomination and was left out of the Director race. Still, the Oscar heat could help the film's legs at the box office over the next few weeks as mature audiences catch up on Academy-endorsed films.

George Clooney's The Descendants expanded on Friday more than tripling its run on the heels of earning five Oscar nods and jumped back into the top ten at number seven with an estimated $6.6M. Now getting a second life in its 11th week of release, the Fox Searchlight film boosted its theater count by 257% from 560 locations to 2,001 and watched its weekend gross jump 176% although its average fell by 23%. The Alexander Payne-directed pic has banked $58.8M to date and could rake in a lot more thanks to the Oscar heat and the fact that it has some star power and mainstream appeal.

Former number one Contraband followed with an estimated $6.5M, down 46%, giving Universal $56.4M to date for the Mark Wahlberg actioner. Disney's 3D makeover of Beauty and the Beast dropped 39% to an estimated $5.3M for $41.1M so far. The animated film's lifetime gross including the 1991 original release plus the 2002 special edition is now $212.5M. Rounding out the top ten was Steven Soderbergh's action thriller Haywire which fell a sharp 53% in its second weekend to an estimated $4M putting the Relativity title at $15.3M in ten days.

Oscar nominees all hustled this past week to turn nominations into extra box office. Distributors worked hard to cash in as Academy endorsements and media hype can translate into broader moviegoer interest, especially for smaller films that need more convincing. But with this game comes added expenditures as more prints are needed and additional advertising is purchased so the net "Oscar bump" is nearly impossible to calculate.

The undisputed front-runner The Artist expanded from 662 to 897 theaters and saw its weekend take rise 40% to an estimated $3.3M giving The Weinstein Co. a total of $16.7M with plenty more to come. Its average of $3,696 was not too impressive but it did inch up 3% from last weekend. A near-impossible sell in the U.S. market, The Artist is now fully in the spotlight and positioned to pull in audiences that would not have purchased tickets before. There will still be resistance to the silent 1930s-set French-produced film from the broader mainstream crowd so the cume will only rise so high. But with numerous wins including the top film prizes from both the PGA and DGA, the Golden Globe for Best Picture - Comedy or Musical, Critics Choice awards for Picture and Director, plus ten Academy Award nominations, The Artist is clearly the film to beat and can extend its box office fortunes past Feb 26 if it pulls off a big victory.

Martin Scorsese's Hugo, which led all films with 11 Oscar nods, enjoyed a similar expansion from 650 to 965 sites and grossed an estimated $2.3M. Its boost of 143% was much greater as the 3D film is more accessible and includes characters speaking to each other. Paramount's total is $58.7M. The incredibly expensive production did not fare too well during its initial run but now has a chance add to its cume by reaching those who missed it the first time around. Fellow Best Picture contender War Horse did not benefit much as the Spielberg pic fell 37% to an estimated $2M raising the sum to $75.6M. The war drama lost nearly 700 screens but also saw its average drop too.

Following its qualifying run, Glenn Close's Albert Nobbs opened in limited release after nabbing three Oscar nominations and grossed an estimated $773,000 from 245 theaters for a sluggish $3,155 average. The overall cume is $823,000 for Roadside Attractions and reviews have been mixed for the film but solid for Close's performance as a woman playing a man.

Elsewhere below the top ten, Tom Cruise's Mission: Impossible - Ghost Protocol achieved a pair of notable milestones this weekend. The domestic haul broke the $200M mark with $202.6M thus far while the international run continued to shine raising the overseas tally to $369M. The action hit is now the top-grossing installment of the popular franchise with a global gross of $571.6M and counting thanks in part to a solid debut in China where it raked in $12.7M in only two days more than quintupling the opening of the last Mission: Impossible picture there. The $600M barrier will be crushed soon.

The top ten films grossed an estimated $92.5M which was up 6% from last year when The Rite opened in the top spot with $14.8M; but down 11% from 2010 when Avatar stayed at number one yet again in its seventh frame with $31.3M.

China's Wen: government debt risk "controllable" (Reuters)

BEIJING (Reuters) ? China's Premier Wen Jiabao said the nation's government debt is at an "overall safe and controllable" level, that funding for key projects would be ensured and that applying the brakes to the economy would be done in a way to avoid systemic risks.

Wen's comments, reported in the official People's Daily on Monday, were made in a speech dating back to early January at the government's flagship financial work conference.

Wen pledged to contain and defuse local government debt risks and avoid the spread of financial risks.

"Currently, our government debt is overall safe and controllable," he said.

"We are taking the issue of managing local government debt very seriously. Through clean-ups and regulation, the trend of expanding investment vehicles has been effectively contained."

China's state audit office said earlier this month it had uncovered 530 billion yuan ($84 billion) worth of irregularities involving local government debt.

But the figure is a fraction of the 2 trillion-3 trillion yuan of sour loans economists believe are buried in the 10.7 trillion yuan of debt local governments had at the end of 2010.

The scale of debt worries investors because it could rock the banking system.

Wen said China "must both actively and appropriately ease financial and fiscal risks, and also ensure the funding needs of key construction projects approved by the government."

He warned, though, against a simplistic approach to local government investment.

"We cannot simplistically hit the breaks and use a one-size-fits-all approach, and must avoid turning localized risks into comprehensive, systemic risks," he said.

Wen also vowed to "break monopolies" against private capital participation in the financial sector, promising to "relax entry to encourage, guide and regulate the entry of private capital into the financial services sector, with participation in the ownership reform, capital enhancement and share expansion of banking, equities, insurance and other financial institutions."

Jordan's king receives Hamas leader (AP)

AMMAN, Jordan ? A high-profile visit to Jordan by the leader of Hamas has revived contacts with the Palestinian militant group, but Jordan will not lift a ban on its activities there, a senior Jordanian official said Sunday.

Khaled Mashaal's visit was part of Jordan's efforts to engage with previously shunned Islamists, who have been gaining ground across the region in Arab Spring uprisings.

"It will only break the ice, following years of estrangement," said the official, who was attending talks between Khaled Mashaal and Jordan's King Abdullah II, "but Hamas will not be allowed to reopen its offices in Jordan."

Re-establishing contact with Hamas also positions Jordan to mediate between Israel and the Palestinians.

Mashaal holds a Jordanian passport, but the kingdom expelled him and four other Hamas leaders in 1999 for "illicit and harmful" activities, forcing Mashaal to set up camp in exile in Syria, from where he has led his group's political bureau. With the harsh Syrian government crackdown on protesters ? including some Palestinians in Syria ? Mashaal is looking for a new place to operate.

Jordan blacklisted Hamas after an alleged weapons cache was discovered in the country six years ago.

Since then, Mashaal was allowed to enter Jordan twice on humanitarian grounds ? in August 2009 to attend his father's funeral, and again last October to visit his ailing mother.

Speaking to reporters after the meeting on Sunday, Mashaal said Hamas was eager to develop "close and unique relations" with Jordan. He suggested more meetings could follow.

"Hamas also cares for Jordan's security and stability," he said.

Mashaal also acknowledged "limits and ceilings" in the relationship, which he said Hamas "respects," but he did not say if the group asked the king to reopen its offices here.

Jordanian officials said the matter was not raised.

The visit was arranged by the crown prince of Qatar, which is helping Hamas find a new home.

Hamas, which took over the Gaza Strip violently in 2007, opposes a peace deal with Israel.

Jordan, a key U.S. Mideast ally, has a signed peace treaty with Israel. It strongly advocates a negotiated settlement to the lingering Arab-Israeli conflict.

A revival of contacts with Hamas would also allow Jordan to mediate between Palestinian President Mahmoud Abbas, who heads the moderate Fatah faction and Hamas ? his arch foe since 2007. Egypt has been trying to broker an agreement between both sides.

Jordan hosted five meetings between Israeli and Palestinian negotiators this month in a bid to have them restart their peace talks.

Jordanian Prime Minister Awn al-Khasawneh repeatedly said that expelling Mashaal was a "legal and constitutional mistake which must be corrected."

(AP) ? (AP) ? Drew Gooden scored 23 points and the undermanned Milwaukee Bucks made sure the Lakers' road struggles continued, beating Los Angeles 100-89 on Saturday night.

Kobe Bryant scored 27 for the Lakers, who are 1-7 on the road this season.

Ersan Ilyasova and Mike Dunleavy added 15 points each for the Bucks, who managed to beat the Lakers without two of their best players.

Already scrambling to compensate for the long-term absence of injured center Andrew Bogut, the Bucks found themselves without guard/forward Stephen Jackson on Saturday because of an NBA suspension.

Bryant made six free throws to break Jerry West's franchise record for free throws made. Coming into Saturday's game, Bryant needed three makes to tie West's mark of 7,160.

Bryant also came closer to becoming the Lakers' career leader in field goals made. He was 10 of 21 from the floor Saturday, leaving him three short of the 13 field goals he needed to tie Kareem Abdul-Jabbar's franchise record of 9,935 field goals made.

Even without Bogut and Jackson, the Bucks were in control most of the way. Ilyasova hit a jumper at the horn to end the third quarter, and the Bucks took an 80-73 lead into the fourth.

The Bucks led 85-76 after an inside score from Ilyasova with just under eight minutes left, but Bryant scored five straight points to cut the lead to four.

But Luc Richard Mbah a Moute hit a jumper, then Gooden scored on a turnaround hook shot and hit a pair of free throws to run the lead back to 91-81.

Andrew Bynum scored inside, but Dunleavy hit a long jumper to give the Bucks a 93-83 lead with just over two minutes left.

After Bryant made a pair of free throws, Dunleavy drilled a 3-pointer to put the game away with 1:24 left.

The Bucks managed the beat the Lakers without Jackson, whose suspension was announced a few hours before the game.

The NBA suspended Jackson one game for verbal abuse of a game official and failure to leave the court in a timely manner at the end of the Bucks' 107-100 loss at Chicago on Friday night.

It's another rough moment for Jackson, who was benched by coach Scott Skiles in the Bucks' Jan. 20 game at the New York Knicks.

Bogut, meanwhile, fractured his left ankle in Wednesday's game at Houston and is expected to miss eight to 12 weeks ? a crushing blow for Milwaukee.

Without Bogut, the undersized Bucks faced a tough test from the Lakers' pair of 7-footers: Pau Gasol and Andrew Bynum.

But they held their ground on defense early on, taking a 51-43 lead at halftime. The Bucks forced the Lakers into 10 turnovers in the first half, and limited Gasol to six points on 3 for 10 shooting.

Gasol finished the game with 12 points and 15 rebounds, but was 6 for 18 from the floor.

Lakers rookie guard Andrew Goudelock scored 13 points despite being hospitalized for dehydration overnight. Goudelock was coming off his best performance of the year, having scored a career-high 14 points against the Clippers on Wednesday.

Bradley Cooper, Zoe Saldana celebrate at Sundance (AP)

PARK CITY, Utah ? Bradley Cooper and Zoe Saldana came to the Sundance Film Festival to promote their closing-night film, "The Words."

The two actors play a married couple in the movie, which follows an aspiring writer who gains fame when he finds an old manuscript and passes it off as his own.

The pair avoided any appearance of their reported off-screen romance by staying apart from one another while posing for photos and giving interviews to support the film. Saldana did affectionately touch Cooper as they passed in a hallway, though.

Both had been to Sundance before, where snow fell throughout the festival and the weather dipped into the teens. Still, Saldana maintained her fashionista edge.

"I did bring warm stuff but I also brought fashion-y stuff. Come on. You've got to pay the price, even if it's too cold," she said.

The 33-year-old actress wore green suede shoes with spiked stiletto heels despite the slushy conditions.

"They're kind of fabulous. They're also lethal. So I have to be really careful, and somebody has to be careful not to piss me off," she said with a smile. "Yeah right. I'm just trying not to fall. It's like `Please don't fall. Please don't fall,' if I'm walking."

Cooper's first time at the festival was 12 years earlier with the eventual cult comedy hit "Wet Hot American Summer."

"I wasn't even able to get into the screening," he recalled.

Saldana said playing Cooper's wife in "The Words" made her think about how she approaches relationships and the concept of unconditional love.

"Like how unconditional am I when I'm in love. Do you bypass certain things? Would I be able to be with a man ? or with someone ? that feels incomplete, doesn't matter what we do?" she said. "If we change this, if we get married, if we have a baby ? just someone that feels incomplete. Would I be able to deal with that for so many years and accept them as who they are and go, `Come as you are. This is who I fell in love with and I don't want to change you?'

"I'm not like that, which is why I wanted to play her, because it was a challenge, you know. Look at me, I totally said I'm not unconditional at all. So awful."

Cooper's part as author-plagiarist Rory Jansen is his second writerly role after playing a novelist in last year's "Limitless." But that's just coincidence, he said. Despite having a degree in English, the 37-year-old actor says he typically only writes in his "girlnal."

"Journal, sorry," he said. "That's a `Wet Hot' reference. Paul Rudd says that."

Saldana, meanwhile, is in the midst of shooting the "Star Trek" sequel in Los Angeles with director J.J. Abrams and much of the original's cast.

"It's wonderful because I've been dying to work with the cast again, to work with JJ," she said. "I love him so much. He's such an amazing human being and such an amazing storyteller and a great director, so what more can I ask for? I start the year and I'm literally going back to a very familiar environment and being a part of a great story."

"The Words," which also stars Dennis Quaid, Jeremy Irons, Ben Barnes and Olivia Wilde, premiered Friday. It was acquired early in the festival by CBS Films, which plans to release it theatrically in the fall. Sundance continues through Sunday.

It?s the end of the world, and Jericho feels fine

With the mere utterance of a single declarative sentence Monday night, Chris Jericho revved up a WWE Universe that has patiently waited since Jan. 2 to hear the former champion say something ? anything ? about his headline-grabbing return. (PHOTOS | WATCH)

Now that the silence has officially broken and it is known that Jericho will take part in the 25th anniversary of the Royal Rumble Match, the WWE Universe moves on to the next step in demystifying his reappearance: figuring out what, exactly, his foreboding intimation on Raw SuperShow is supposed to mean.

As with everything else that Jericho has done since coming back, his curt proclamation Monday night posed more questions than it answered.

?This Sunday at the Royal Rumble, it?s going to be the end of the world as you know it,? he concisely stated during his first ?Highlight Reel? segment on Raw in nearly four years.

Chris Jericho's intimations continue to confound.Aside from paraphrasing the least karaoke-friendly song in R.E.M.?s catalog, Jericho?s apocalyptic prophecy served largely to befuddle viewers. It has not gone unnoticed that Jericho waited until the first month of a year packed with various end-of-the-world conspiracies to deliver his brief doomsday warning. Yet, with the purported end-time date, Dec. 21, 2012, still months away, smart money says the most incandescent thing the WWE Universe will see Sunday is Jericho?s jacket ? not killer solar flares.

Nor has it been forgotten that the cryptic videos trumpeting Jericho?s return shared a common tagline ? ?The End Begins? ? that seems to speak to whatever Armageddon Jericho has in mind for the Rumble.

So how in the world does one begin making sense of these snippets of information, and what do they portend for the Rumble Sunday?

Let?s begin with what is already known: On Jan. 29, live on pay-per-view, Jericho will enter the Royal Rumble Match, marking the first time in more than a year that the first Undisputed WWE Champion in history will actually compete in the ring. (Jericho?s offense during Raw SuperShow?s six-Superstar tag team match two weeks ago was limited to tagging in and out of the action.) With his legacy firmly intact, Jericho has made the bold, if not foolhardy, decision to shake off any lingering ring rust in one of WWE?s most trying and prestigious battling grounds ? the Royal Rumble Match.

By foretelling that the ?end of the world? will happen at the Royal Rumble, maybe Jericho was simply warning his fellow Superstars to not sleep on the cagey warhorse returning from a long layoff. ?It?s not outside the realm of possibility that Jericho believes life for WWE Superstars is easier without him in the picture; perhaps the Royal Rumble Match ? and a Jericho victory ? would signify the end of the cushy life for Superstars who?ve grown accustomed to a post-Jericho world.

Maybe Jericho?s remark Monday concerned all that has transpired in WWE during his absence. Since Randy Orton punted Jericho out of action in late 2010, Raw SuperShow has experienced Superstar walkouts and power grabs, not to mention a revolution started in earnest by WWE Champion CM Punk. Jericho sat on the sidelines while WWE underwent radical changes and an entirely new crop of talent blossomed. Could that be the ?world? to which Jericho?s referring?Since his return, Chris Jericho has been warmly received by the WWE Universe.

Or, perhaps it?s wrong to assume it was other Superstars that Jericho was putting on notice with his comment last Monday.

In examining Jericho?s one-sentence promo, it is important to note the exact verbiage he used: ?the end of the world as you know it.? Could he have even been referring to the loyal WWE Universe, which has embraced Jericho?s sometimes-cheesy antics with open arms?

If so, Jericho?s remark would seem to imply that despite his gushing and, at times, tearful, response to the WWE Universe?s warm reception, Jericho?s worldview does not entirely dovetail with theirs. Maybe Jericho?s premonition foreshadows an end in sight for the good feelings?

With the 25th anniversary of Royal Rumble just around the corner, it is only a matter of days before the veil of mystery is lifted and the thrust of Jericho?s vague promise is revealed for all to see. What is clear in the present moment is that Jericho knows something, and the rest of us can only speculate as to what that something is.

Heating and AC distributors file petition against Energy Dept.

Texas Gov. Rick Perry may have cursed his memory when he forgot the Department of Energy during a Republican debate in Michigan, but some in the heating and air-conditioning industry would certainly like to also forget the DOE.

Heating, Air-conditioning and Refrigeration Distributors International (HARDI), a self-described voice of wholesale distribution within the HVACR industry, has filed a motion to intervene in a lawsuit, through their attorneys, against a new DOE rule which establishes regional standards for air conditioners, heat pumps and furnaces.

The new rules, which go into effect in May 2013, divide the country into three regions with different minimum efficiency standards for HVAC appliances.

According to the Appliance Standards Awareness Project (ASAP), the new regional standards will mean that a typical new air conditioner in the South will use 40 percent less energy, and a typical new furnace in the North will use about 20 percent less energy ?than before national standards were established in the late 1980s.?

?Climates as different as those of Minneapolis and Miami need different furnace and AC standards,? said Andrew deLaski, executive director of ASAP, in a statement. ?Until now, we?ve had one-size-fits-all national standards. These new, regional standards are a major breakthrough that will benefit consumers and the environment.?

Cause of Action, representing HARDI, however, claims that the new standards will result in the loss of nearly 17,000 jobs, $7 million in lost wages and that the elderly will be disproportionately affected because they will not be able to recover the costs associated with purchasing more expensive yet energy efficient appliances.

The group is seeking judicial intervention on the grounds that the DOE did not follow proper procedures when adopting the so-called direct final rule, mandating the regional standards.

?An agency will do this [direct final rule] when it feels like there is no controversy or debate on what the rule is going to be,? Cause of Action?s executive director Dan Epstein told The Daily Caller. ?Under the authority that the Department of Energy promulgated this rule ? which was under the Energy Independence and Security Act [of 2007] ? under that authority an agency can issue a direct final rule under that act but it has to withdraw the direct final rule if it receives any adverse comments from the public which may provide a ?reasonable basis for withdrawing that rule.??

In this circumstance, the DOE determined that it did not receive adverse comments that would have provided a ?reasonable basis for withdrawing that rule? and made the rule final.

According to HARDI and Cause for Action, however, the DOE disregarded the industry?s concerns when considering a ?consensus agreement? and issued the direct final rule despite opposition from the industry.

HARDI is concerned that this ruling could set a poor precedent.

?If we were to simply ignore this abuse of statutory process, all federal agencies would remain unchecked,? HARDI Director of Government Affairs Jon Melchi told an HVACR contractor?s weekly news magazine. ?This rule completely changes the nature of HVAC distribution forever going forward and for the DOE to not impart all due diligence in creating a regulation that impacts the livelihoods of businesses and individuals is counter to the way the regulatory process is supposed to work. This process is a perfect example of why small businesses are angry with Washington, D.C. Our voices and views were not considered.?

The motion to intervene was filed in the U.S. Court of Appeals for the D.C. Circuit and joins the American Public Gas Association?s current lawsuit against the DOE.

The DOE did not respond to requests for comment.

LONDON ? Scotland's leader has presented his proposal for a ballot on independence ? and his ideas include letting 16- and 17-year-olds cast ballots in a vote that could see the breakup of Britain within four years.

First Minister Alex Salmond announced the Scottish government's preferred options for the vote on whether to sever ties from Britain, which it plans to hold in the fall of 2014. A "yes" vote would lead to independence taking effect with a May 2016 election for the Scottish Parliament.

Scotland and England united in 1707 to form Great Britain. Scotland gained significant autonomy after voting in 1997 to set up the Edinburgh-based Scottish Parliament, but some Scots want to go further and make the nation of 5 million people an independent country within the European Union.

Salmond told Scottish lawmakers in the Edinburgh assembly Wednesday that the ballot would ask "Do you agree that Scotland should be an independent country?"

But he said it could also include a third option, backing increased autonomy short of full independence.

And he said the voting age should be lowered from the current 18.

"If a 16-year-old in Scotland can register to join the army, get married and pay taxes, surely he or she should be able to have a say in this country's constitutional future?" Salmond said.

Scottish 16-year-olds can join the army ? though they cannot be sent into combat until they are 18 ? work full-time and marry without parental consent. The official Scottish drinking age outside the home is 18, but even that has some exceptions for 16- and 17-year-olds.

Salmond, who leads the separatist Scottish National Party, said independence would bring "a new, more modern relationship between the nations of these islands ? a partnership of equals."

The exact wording is subject to input from Scottish voters and negotiations with the British government in London, which insists it has the final authority to authorize a binding referendum.

British Prime Minister David Cameron's Conservative-led government has offered the Scottish administration the power to hold a vote on independence, but wants a say in the timing and could insist that the Electoral Commission, which will run the referendum, be allowed to set the question.

Salmond's proposed wording is likely to be seen by opponents as slanted in favor of independence.

Opponents of independence want to hold the vote as soon as possible, because polls suggest only about a third of Scots favor splitting from England.

Cameron has said the ballot should pose a straight yes-no question, and not include a third option, which has been dubbed maximum devolution. Salmond disagrees.

"If there is an alternative of maximum devolution which would command wide support in Scotland, then it is only fair and democratic that option should be among the choices open to the people of Scotland," Salmond said.

Cameron stressed Wednesday that everyone in Britain, not just Scots, should have a say in any changes to Scotland's status.

"The point that everyone needs to understand is that options for further devolution, options for changes across the United Kingdom, are matters all of the United Kingdom should rightly discuss," he said.

Michael Moore, Cameron's minister responsible for Scotland, was due to hold talks with Salmond on Friday but the meeting was postponed because Moore has chicken pox.

Salmond said an independent Scotland would keep Queen Elizabeth II as head of state but would not send troops to "illegal wars like Iraq, and we won't have nuclear weapons based on Scottish soil." Scotland is currently home to Britain's fleet of nuclear-armed submarines.

Scottish Labour leader Johann Lamont, whose party opposes independence, accused Salmon of belittling Scots who wished to remain in Britain.

"Why does he assert as fact that we all wish to be independent of each other when we all know, as families and communities, we want to come together in partnership and cooperation?" she said.

US inmate arrested for refusing to leave lockup

(AP) ? Most people can't wait to leave jail, but one northern Arizona inmate has been charged with trespassing after refusing to leave the Coconino County lockup.

Coconino County Sheriff's Office spokesman Gerry Blair says 44-year-old Martin Batieni Kombate was arrested in Flagstaff last week for trespassing and was scheduled for release Monday on his own recognizance on the charge.

But when detention officers from the sheriff's office showed up to escort him out, Kombate allegedly said he wasn't leaving and was staying because he couldn't find his wallet.

Blair tells The Associated Press that Kombate was disorderly in a jail cell, would not leave, so the police were called and Kombate was arrested.

Blair says Kombate remains in jail.

NEW YORK (AP) ? Apple has again surpassed Exxon as the most valuable U.S. company after an excellent quarter.

Apple Inc.'s stock rose nearly 6 percent to $445.29 in midday trading Wednesday, bringing the iPhone and iPad maker's market capitalization to $415 billion.

Meanwhile, Exxon Mobil Corp. shares are down 1 percent at $86.52. That gives it a market cap of $414 billion.

Apple said Tuesday that net income in its latest quarter more than doubled, while revenue grew 73 percent.

Cupertino, California-based Apple first topped Exxon as the most valuable company in August, then fell back to second place. The Irving, Texas-based oil and gas giant had held the top spot since 2005.

Apple overtook Microsoft Corp., now in the No. 3 slot with a market cap of $247 billion, in 2010.

Alito vs. Scalia

Having said all this, Sotomayor then launches into a terrifying exposition about all the ways in which government surveillance no longer actually requires any physical intrusion, and she notes that Scalia?s majority opinion offers no future guidance for regulating such surveillance. Sotomayor cautions that new surveillance systems will fundamentally alter the relationship between government and citizens. She writes, ?I would ask whether people reasonably expect that their movements will be recorded and aggregated in a manner that enables the Government to ascertain, more or less at will, their political and religious beliefs, sexual habits, and so on.? She goes on to warn about an even more worrisome violation of privacy when one?s personal information is voluntarily disclosed to third parties, noting, ?I for one doubt that people would accept without complaint the warrantless disclosure to the government of a list of every Web site they had visited in the last week, or month, or year.? Because she joins on with Scalia?s majority opinion, however, these musings are?at least for now?just high-tech musings.

Freezing rain, snow cover parts of Upper Midwest (AP)

MINNEAPOLIS ? Freezing drizzle and rain made roads slick Sunday as a winter weather system moved across portions of the Upper Midwest, and the precipitation was expected to begin changing over into snow that could continue into Monday.

The National Weather Service issued warnings about freezing drizzle and rain for parts of Illinois, Iowa and Minnesota and Wisconsin on Sunday, and a fog advisory was out in south-central Wisconsin.

The advisories could be expanded later Sunday, the weather service said. The precipitation was coming from a low pressure system expected to track east across Nebraska and Iowa and deepen as it moved northeast across Wisconsin, it said.

Snow was expected Sunday in Nebraska and the Dakotas with a few inches falling in parts before midnight, the weather service said.

In other states, the changeover from rain to snow was expected to start Sunday evening and move from west to east, continuing into Monday morning. One to two inches of snow were possible by Monday in the Twin Cities area of Minnesota and parts of central Wisconsin, the weather service said.

In southeastern Minnesota, Rochester police responded to more than 70 crashes on slick roadways Sunday morning, Lt. Mike Sadauskis said.

"People probably need to take their time a little bit better, give themselves a little bit more space," he said.

Ice also was expected to develop roads and sidewalks in the Twin Cities and elsewhere in the region, with up to a tenth of an inch of ice was possible, the weather service said. It urged drivers to be cautious and anticipate road conditions to deteriorate throughout the evening.

Glazing was reported Sunday across portions of northeastern Iowa and southwestern and central Wisconsin, the weather service said. In the Milwaukee area, freezing fog could reduce visibility to less than a quarter of a mile, it said.

North Dakota got freezing rain and snow Saturday into Sunday that left roads in the southern half of the state coated with ice.

Strong winds were expected in Arkansas, Oklahoma, Texas and Nebraska, where light snow began in the western part of the state Sunday afternoon.

The worst of Nebraska's storm was expected Sunday evening, with 2 or 3 inches of snow falling expected in some parts. The weather service said the main threat from the storm was likely to be blowing snow that could limit visibility Sunday evening.

'Probably not a good fit' for Tigers

Victor Martinez?s season-ending knee injury puts the Tigers in the market for a veteran designated hitter and has some fans getting their hopes up for Prince Fielder, but general manager Dave Dombrowski threw cold water on that notion yesterday.

Angela Wittrock of MLive.com asked the GM about Fielder during the Tigers? winter caravan tour and Dombrowski replied:

Of course we?d consider Prince Fielder, but realistically it?s probably not a good fit. We anticipate Victor Martinez coming back in 2013 and playing at the level he was at last season. I would just say the fit is really not there at this point.

Fielder might make sense as a Martinez replacement this season if the Tigers were willing to dramatically expand their payroll, but the problem is that Fielder will require a long-term deal and Martinez is owed $13 million this year, $13 million next year, and $12 million in 2014. And the Tigers also have first baseman Miguel Cabrera under contract for $86 million over the next four seasons.

RIM's Jim Balsillie and Mike Lazaridis are out, new CEO Thorsten Heins may license BlackBerry 10

After months upon months of investor backlash, RIM's making some significant changes. And by "significant," we mean the co-chief executives (and founders) are out. As of tomorrow, both Jim Balsillie and Mike Lazaridis will be stepping away from the top posts, enabling "a little-known company insider" to take over, according to The Wall Street Journal. Purportedly, this is all part of "a board and management shuffle," with COO Thorsten Heins (seen above) to step into what many expect to be an impossible role to thrive in. The Globe and Mail asserts that he'll be immediately seeking a Chief Marketing Officer to polish up the company's severely damaged brand, and he "will not rule out licensing RIM's new BlackBerry 10 operating system to other handset manufacturers." In an interview with the outlet, he stated that he'll be executing "flawlessly" and with vigor -- not unexpected, but still, bold words.

Startlingly, Heins also asserted that he's "confident" in the existing lineup of BlackBerry handsets and the software update recently made available for the PlayBook; call us crazy, but he'd be wise to just spout out reality and make clear that RIM's existing lineup is nowhere near competitive in the grand scheme of things. As for Mike and Jim? The former will become "vice-chair of the board with special duties to examine innovation," with the latter becoming a traditional director. In an interesting move, outgoing co-CEO Lazaridis stated the following: "I think it's that unwillingness to sacrifice our long-term value for short-term gain. That's why we didn't choose Android. That's why we decided to build the future on QNX." So wait, RIM had the chance to choose Android... and didn't? No time like the present to reach back and shake things up, Mr. Thorsten.

(AP Photo/Charles Platiau, Pool)

(AP) ? France suspended its training operations in Afghanistan and threatened to withdraw its entire force from the country early after an Afghan soldier shot and killed four French troops Friday and wounded 15 others.

The shooting ? the second such attack in a month ? came during a particularly deadly 24 hours for the international military coalition. Six U.S. Marines also died in a helicopter crash late Thursday.

It was the latest in a series of attacks by members of the Afghan security forces or infiltrators in disguise against coalition partners that have raised fears of increased Taliban infiltration of the Afghan police and army as foreign combat forces prepare to withdraw from the country by 2014. The impact of the French suspending training operations is unclear, but it would result in a major setback for the U.S.-led coalition if other troop-contributing nations stopped training Afghan national security forces or decided to pull out earlier than planned.

French officials said the Afghan soldier opened fire with an unspecified automatic weapon shortly after unarmed French soldiers had finished physical training exercises. French military spokesman Col. Thierry Burkhard said the soldier appeared to have had authorization to enter Forward Operating Base in Gwan in Tagab district of Kapisa province. Three quarters of the 600 soldiers on the base are Afghan and the rest are French, Burkhard said.

President Nicolas Sarkozy announced the French deaths in Paris and the suspension of training programs. He did not specify how many French forces or which programs would be affected.

"The French army is in Afghanistan at the service of the Afghans against terrorism and against the Taliban. The French army is not in Afghanistan so that Afghan soldiers can shoot at them," Sarkozy said.

He added that if security for troops is not restored, "then the question of an early withdrawal of the French army would arise."

Defense Minister Gerard Longuet said the French soldiers were unarmed when the attacker opened fire during a very difficult training exercise at high altitude. French military officials said 15 other French soldiers were injured

"We don't know at the moment whether it's a Taliban member who infiltrated, or someone who decided (to attack) for reasons that we don't know," Longuet said on France-2 television.

He said the Afghan was in custody of the Afghan army's 3rd brigade, held by a general "whom we trust."

A Taliban spokesman, Zabihullah Mujahid, praised the Afghan attacker but did not claim he was an infiltrator or provide other details.

Afghan President Hamid Karzai expressed deep regret over the attack.

Afghan Ministry of Defense spokesman Gen. Mohammad Zahir Azimi said the ministry had sent a delegation to the area to investigate the shooting, he said. He said the attacker was arrested and was being questioned.

Friday was among the most deadly days for French forces in the 10 years they have been serving in the international force in Afghanistan. The latest deaths bring to 82 the number of French troops killed in the Afghan campaign.

"From now on, all the operations of training and combat help by the French army are suspended," Sarkozy said.

The defense minister and the chief of staff of the French army are heading Friday to Kabul. Once they report back, Sarkozy said, the French government will decide how to proceed.

A big part of the French role in Afghanistan recently has been training Afghan troops and police ahead of an expected pullout of the around 3,600 French troops currently there in 2014.

Unpopular at home, Sarkozy is facing a potentially tough re-election campaign for elections in April and May and appeared determined Friday to act swiftly and sternly to the latest troop deaths.

The candidate who tops opinion polls ahead of France's elections, Socialist Francois Hollande, said in a statement Friday that he would aim to pull out French forces by the end of this year if he becomes president.

Friday's attack was all the more painful for the French because it came just weeks after an Afghan army soldier shot and killed two members of the French Foreign Legion serving in the NATO force on Dec. 29. French forces fired back and killed the assailant.

It remained unclear how likely or swift a French pullout could be. France has the fourth-largest force in the international coalition.

"Today there is clearly a new truth. It is not the first time that an Afghan soldier ... assassinates French soldiers," Foreign Minister Alain Juppe said. He called it a question of "responsibility to adapt our timetable for withdrawal by taking into account these new circumstances."

Longuet was more cautious, saying French officials should maintain calm when making any decisions.

Sarkozy said he'd discuss France's role in Afghanistan with Karzai when he visits Paris next week.

Afghan security forces or insurgents dressed in their uniforms have attacked and killed international troops or civilian trainers more than a dozen times in the past two years, according to an Associated Press count.

Earlier this month, a U.S. service member was killed when a man in an Afghan army uniform opened fire at a base in the south of the country.

In one of the worst incidents, a veteran Afghan military pilot opened fire at Kabul airport on April 27, 2011, killing eight U.S. troops and an American civilian contractor.

In Riga, Latvia, NATO Secretary-General Anders Fogh Rasmussen said this was "a very sad day for our troops in Afghanistan and for the French people," but insisted that such incidents are "isolated."

The helicopter crash, which occurred in the southern Helmand province, was the deadliest in Afghanistan since August, when 30 American troops died after a Chinook helicopter was apparently shot down in Wardak province in the center of the country.

The cause of Thursday's crash is still being investigated, but a coalition statement said there was no enemy activity in the area when it happened.

A senior U.S. defense official said all six reported killed were U.S. Marines and there was no indication that the helicopter had been hit by enemy fire. The defense official spoke on condition of anonymity because the U.S. command in Afghanistan had not yet publicly released details, including the nationalities of the dead.

Taliban spokesman Qari Yousef claimed insurgents shot down the helicopter, a Chinook, in Musa Qala district of Helmand province, killing all on board. The Taliban frequently exaggerate the number of people they claim to have killed.

Police question witnesses in Hollywood severed head (Reuters)

LOS ANGELES (Reuters) ? Authorities have identified the man whose severed head, hands and feet were found in the hills below the famed Hollywood sign overlooking Los Angeles, but declined to release his name on Friday as homicide detectives questioned witnesses in the bizarre case.

Two women walking dogs stumbled upon the decapitated head in Griffith Park earlier this week, and a search later turned up the hands and feet, which Los Angeles police said came from the same person.

Investigators have so far been unable to say how the man, whose age had been estimated at between 40 and 60, died or came to be dismembered, but a Los Angeles police spokesman said his identity had been established.

"We have identified the victim but we have not released that," Lieutenant Andrew Neiman said. He said homicide detectives were questioning witnesses and potential suspects but that no arrests had been made.

Neiman declined to comment on reports in the local media that a search warrant had been served at an apartment building in Hollywood in connection with the case.

"Most homicide investigations involve the service of search warrants and various locations, and certainly that is something that will probably be part of this investigation," he said.

Police said detectives had canvassed the area near the 4,200-acre Griffith Park in the heart of Los Angeles looking for clues or potential witnesses before the section of the park where the body parts were found reopened to the public on Friday.

Commander Andrew Smith said he believed that a bodyguard for actor Brad Pitt was among those witnesses interviewed but said the man was not considered a suspect.

The sensational case began on Tuesday when a mother and daughter walking dogs came across the head in a plastic bag and reported it to park rangers. The hands were found the following day in the same general area, one by a cadaver-sniffing dog and the other by a crime scene investigator.

Later on Wednesday, a coroner investigator discovered the feet, together, in the same area.

Neiman said investigators theorize that the head, hands and feet were hidden together in the park and later scattered by animals.

"The hands and feet were found in the same general area and the head was in a different location," he said. "We believe an animal may have pulled that body part and the first hand away."

Police have found no link between the Hollywood Hills case and a torso found in Arizona missing a head, hands and feet, and said there was no evidence the man was a victim of organized crime or a serial killer.

The iconic Hollywood sign on Mount Lee above Los Angeles was built in the 1920s to promote a housing development and originally read "Hollywoodland." The last few letters deteriorated in the 1940s and the part that remained was restored in 1978.

Griffith Park, which sits in the hills above metropolitan Los Angeles, is the largest municipal park with an urban wilderness area in the United States, according to a city website.

Kanchha, our Sherpa guide, took off at an unexpectedly fast pace along what seemed little more than a dry and dusty yak track.? We chased after him as best we could, affected as we were by the combination of altitude and the large lunch we had just consumed at the teahouse at Thokla.

Our destination was Chola Tsho, a large glacial lake contained in a valley formed by two comparatively minor peaks, Awi (17,208 feet) and Arakam Tse (21,073 feet), and held in place by the Chola glacier.? The trail undulated radically (ironically, the locals call this type of terrain ?Sherpa flat?), and so it took us close to 40 minutes to walk the 1.5 miles around the hill to the lake.? I had read several articles about the effects of climate change on glacial lakes in this region and was keen to visit one myself to try to understand the problem.

I was in Nepal, trekking in the Himalayas toward the base camp at Mount Everest.? Since I was a boy growing up in England, I had dreamed of walking through these mountains and maybe even one day of climbing to the top of some of the highest peaks on Earth.? Now I was here, on a site visit exploring the possibilities of establishing a program to bring students and alumni to this magnificent place.

The scale and beauty of the Khumbu region was beyond anything I had experienced elsewhere, and while I relished each beautiful day of hiking, it was clear that this region is suffering from the effects of global climate change. It reminded me of the canary in the coalmine; changes in this highly sensitive region appear to presage significant global changes that might dramatically affect all human existence.

Average temperatures in Nepal have risen 1.8oF between 1971 and 1994, with the most extreme increases noted during the dry winter months. This was twice that of similar mid-latitude Northern Hemisphere warming trends over the same time period and was especially great in the Himalayan ranges where we were hiking.

Chola Tsho sits at an altitude of 15,150 feet, and we were several hundred feet higher up the hill, yet even in early December the skies were clear and the daytime temperature reached the mid-60s. Although extremely comfortable and photogenic, this did not feel right.

Anecdotal reports, both published and from our guides, suggest that snowfall amounts at higher elevations between November and January have decreased significantly over recent years, and that the monsoon season, normally between May and September, is becoming less reliable. In other words, it seemed as though we were witnessing the effects of climate change firsthand.

It was not just the smaller peaks that were showing signs of stress; even the summit of Everest itself is affected.? According to published witness reports by Apa Sherpa, who in 2011 at the age of 50 climbed Everest for a record 21st time, there is less snow on the mountain. ?The snow along the slopes had melted, exposing the bare rocks underneath, which made it very difficult for us to walk up the slope, as there was no snow to dig our crampons into,? he said. ?This has made the trail very dangerous for all climbers.?

Downstream Chola Lake

Apa reports that some expeditions no longer have to melt snow for drinking and cooking at Camp 2 at 21,300 feet, and that he saw running water around Camp 4 on the South Col at 26,000 feet for the first time in 2009. He describes that weather patterns have changed dramatically in the foothills, too, and that potato yields and yak numbers have declined.

Other crops now grow at higher altitudes and have longer growing seasons than in the past. On our trek from Lukla (9,400 feet) to Namche Bazaar (11,280 feet) a few days earlier, we had passed many gardens with healthy crops of cabbage, garlic and bok choy growing far later in the season than they used to, according to our guides. Mosquitoes were found in Namche for the first time in 2008, and there are even reports of houseflies at Everest Base Camp at 17,300 feet. Similarly, we were surprised to see a butterfly hitchhike on the sleeve of one of the Sherpa at 15,000 feet during one of our hikes.

Upstream Chola Glacier

All these observations are consistent with the effects of climate change in this region.

At that moment, the milky green waters of Chola Tsho faced us. Like other glacial lakes in the region, it has been growing as a result of increased snowmelt from the surrounding peaks and from the retreating glacier itself. If trends continue, it seems likely that the moraine dam holding the lake in place will fail, releasing a massive inland tsunami of water and rock to wash down the valley toward the small town of Pheriche.

In the next valley to the southeast, an even more dangerous lake, Imja Tsho, sits at the base of Imja Tse (Island Peak). This lake, now up to a mile and a half long, over a quarter mile wide and 300 feet deep and the fastest growing major glacial lake in Nepal, is the subject of intense international scrutiny by scientists seeking to understand the nature of the risk.

If?or is it when?the lake bursts through its moraine dam, a wall of rock, mud and water will sweep down the valley, destroying homes and land for a generation. The town of Dingboche, where we stayed for two nights to acclimate to the high altitude, is in the path of this predicted GLOF and would undoubtedly be completely destroyed. Following similar warnings a few years ago, some residents moved their livestock to higher ground and evacuated the town. As described to us by our guides, they returned after a few days without incident but remain uneasy about the prospects of a catastrophe.

Chola and Imja are just two lakes that threaten this region. Seven miles to the west of Chola Tsho lies the Gokyo valley and the Ngozumpa glacier, which flows from Cho Oyo, at 26,906 feet the world?s sixth tallest mountain. The moraine field at the southern end of the glacier has created Spillway Lake, which has the potential to reach four miles long, six-tenths of a mile wide and 350 feet deep. This lake, fed by a series of smaller lakes sitting on the surface of ice interconnected by caverns and subglacial streams, has been observed to drain and refill within a matter of days as ice melts upstream.

Significant though these local changes are, they pale next to the loss of the Himalayan glacial system as a whole. Here, glaciers are retreating faster than anywhere else on earth, and predictions suggest they may all disappear within 50 years. It is estimated that 1.3 billion people live in regions affected by the Himalayan system, either in flood-prone areas or through their reliance on reliable glacier-derived fresh water. Huge areas of Asia could become uninhabitable if these rivers of ice are lost.

Chola Lake

We had spent close to an hour overseeing Chola Tsho, taking photos and considering how change will surely come to this region, before our guide, with a grin on his face, brought us back to task. We had to get moving if we were to reach our destination at Lobuche, two miles and another 1,500 feet higher up the track to the north, before the sun set behind Cholatse.

Under the clear, warm skies of December, watching rivers roar downstream carrying melt water from Everest south to the plains of Nepal and beyond, I was struck by conflicting feelings of privilege, awe, guilt and humility.? As we climbed up a steep slope to rejoin the trail, struggling once again to keep up, I thought about how long this unique environment could stay the way it is. How was it that the Sherpa we met were so friendly and welcoming and seemed not to harbor any grudge against the outside world that caused these problems? Could local solutions to relieve glacial lake pressures be developed in time to avoid catastrophe? Were global solutions to combat climate change even possible in this hyper-political world? What could I do?

Back in the United States, with time to reflect on these experiences, I think the best thing that I can do is tell people what I learned: that the canary isn?t doing so well these days.
