We're spending?more ? and saving less

By John W. Schoen, Senior Producer

The daffodils are up, the job and housing markets are improving, businesses are more upbeat and consumers are getting back in a spending mood.

Unfortunately, American households are dipping into savings and tapping credit cards to pay for their latest shopping spree. Unless their paychecks begin expanding at the same pace, the new?spending, and the boost it's giving to the economy, may not be sustainable.

"While households want to spend and will raid their bank accounts to support that habit, unless income gains start improving consumption will have to slow," said Joel Naroff, chief economist at Naroff Ecoomic Advisors.

After a long, slow recovery from the 2007 recession, consumers are feeling more upbeat about the economic outlook in 2012. Five years after the worst housing collapse since the Great Depression, home prices in many markets are beginning to stabilize and sales are perking up. The job market, though still very tight in?many industries and occupations, has been creating new openings at a healthy clip. The stock market is up nearly 30 percent in the past six months.

All of which?helped boost consumer confidence to its highest level in more than a year in March, according to the latest reading by Thomson Reuters and University of Michigan. The upbeat mood has been showing up in other consumer surveys.

It's also showing up in the data on consumer spending, which rose 0.8 percent, according to the Commerce Department. Spending on durable goods like cars and trucks rose sharply. January's spending was revised up to 0.4 percent from a previously reported 0.2 percent gain.

The spending gains have also helped boost wider optimism about the economy and has prompted some forecasters to lift their estimates for the pace of growth this year.

"So long as the consumer is spending, that's the biggie everyone is watching as they drive the economy," said Wayne Kaufman, chief market analyst at John Thomas Financial.

Not all of the spending boost came from increased confidence. Higher gasoline prices have forced households to shell out more at the pump even if their paychecks are able to stretch far enough to make up the difference. The energy component of the Commerce Department's spending data surged 3.6 percent last month, largely due to higher gasoline prices, which have jumped 62 percent so far this year.

?Some forecasters think the pain at the pump will get worse before it gets better.

"The bad news is that pump prices will start approaching the $4.15-$4.20 per gallon range by Memorial Day," said Chris Christopher, a senior economist at IHS Global Insight. "The good news is that a relatively stronger job and stock market are assisting in holding up consumer spending and confidence."

After several false starts, the job market seems to be gaining strength, adding nearly 250,000 jobs a month for the last three months, helping to bring the unemployment rate down?to 8.3 percent from 9.0 percent in September.

Some small business owners are report that they plan to hire this year. About a third of those surveyed by payroll processor Sure Payroll said they plan to take on more workers in 2012, with only two percent planning layoffs. The rest expect to keep staffing levels where they are. Nearly 80 percent of those polled said the pace of business met or exceeded their expectations in the first three months of this year.

The hope is that continued improvement in the job market will translate into higher wages, which would help sustain the recent pickup in spending. Until then, consumers are leaning on their savings and credit cards to pay for the spending increase. Personal income inched up just 0.2 percent last month;?disposable income, the amount left after taxes and inflation, fell for a second straight month,

That means dipping into savings and borrowing more. The savings rate, the amount of disposable income households have socked away, dropped to 3.7 percent, the lowest rate since August.

After steadily declining during the recession, the total level of revolving credit outstanding bottomed in May 2010 and is up 8.3 percent since them, according to the latest data from the Federal Reserve.

CNBC's Rick Santelli has the consumer sentiment data, which jumped to 76.2 vs. 75.3 in February.

Travel photo of the day: Storm batters Maine coast

Submitted by David Jordan / UGC

A weakened Hurricane Earl sweeps by Cape Elizabeth, Maine, on Sept. 2, 2010.

When?Hurricane Earl?passed?by the New England coast in 2010, David Jordan headed out with his youngest daughter?to Portland Head Light, an historic lighthouse in Cape Elizabeth, Maine, to photograph the crashing waters.

The two spent a couple of hours walking the pathways that run along the top of the cliffs, each taking dozens of photos?while looking for the ideal?vantage point.

"The Maine coast is always beautiful but having a storm off the coast churning up waves adds some flavor and gives you the opportunity to capture that one moment out of time ... in this case wind-driven waves breaking 30 to 40 feet high along the rocky coast," Jordan told TODAY.com.

He used Photoshop to convert the image to black and white to better capture the dramatic tones, and added some vignetting. The photo won last week's gallery.

If you have photos you'd like to share,?submit them?for a chance to be featured in our reader photo gallery.

For Palestinian, a reminder of Israeli occupation

Paul Goldman / NBC News

Abu Nidal, 70, stands on his land in the Palestinian village of Al-Walaja. Construction of the Israeli security barrier can be seen in the background.

By Paul Goldman , NBC News

AL-WALAJA, West Bank ?? Palestinian activists are calling for a ?Global March to Jerusalem? this Friday to mark Land Day, an annual event that commemorates the killing of six Arabs who were protesting the Israeli practice of expropriating Arab land to build Jewish settlements on March 30, 1976.

Since then Palestinians have commemorated March 30 as Land Day and have turned it into a general day of protest against what they see as discriminatory practices by the Israeli government.

But 70-year-old Abu Nidal doesn?t need a special calendar day to remind him of the Israeli occupation and their confiscation of his land. Nidal just needs to wake up every morning and look outside his window to see how the Israelis are confiscating his land.

?He lives in the village Al Walaja, nestled in the hills between Jerusalem and Bethlehem. Half of the village of just over 2,000 is considered to be part of Jerusalem and the other half is part of the West Bank. So now the Israeli security wall snakes through the village.

?Land Day is like a music record being played over and over,? he said. ?I live out of despair with no future in sight, I see no light only darkness.?

When the Israelis sent huge yellow bulldozers to the village in 2010 to start working on the separation wall, no one bothered to check on whether or not the wall ran through Nidal?s farm land ? which it does. And it has not only been 86 olive trees that were up rooted by the approximately?26-foot high concrete barrier, but also Nidal?s family graveyard.

Paul Goldman / NBC News

Parts of the Israeli security wall are still under construction, while others are already snaking through the West Bank village Al-Walaja.

It was his grandmother?s wish that every family member be buried on their 11-acre farm land. But the Israelis have a different plan for the confiscated land. They are planning to build not only the wall, but a recreational park for Israelis on the other side of the wall.
As it stands now, Nidal can only look at his mother and grandmother?s graves from a distance with the dreadful knowledge that soon the wall will be his only view.

?It?s not only a question of land confiscation, but also of making our life so miserable that we will have to pack up our lives and leave,? Nidal said. ?But, of course, I want to be buried alongside my mother.?

This Friday when demonstrators take to the streets commemorating Land Day, Nidal won?t join them; his battle is being waged in the Israeli courts. But he pointed out that his case doesn?t have much of a shot. ?The court is Israeli, the judge is Israeli and the lawyers are Israelis.? It?s a losing battle.?

Nidal?s story is just one out of many. There are approximately 2,300 Palestinians living in the village of Al Walaja and everyone I talked to had a similarly desperate story. The common theme to all the stories is the feeling they live in a prison surrounded by a wall and Jewish settlements.

Joshua Ledet: An Angel on American Idol?

Like Elise Testone last night, Joshua Ledet tackled one of the most difficult songs an American Idol finalist can cover: "Without You," originally written by Harry Nilsson and performed by Mariah Carey.

Did he pull it off?

Hmmm... let's ask Jennifer Lopez: "You are a phenom! You are an absolute angel from heaven. That voice is a godsend!"

We think that's a yes. Ledet poured every ounce of emotion he could into the audition, wiping his brow at one point as the violinists played behind him and showing off his incredible range via multiple runs in the middle. Watch now and try not to be impressed:

PROSTATE CANCER TREATMENT ? Op. Dr. Ali G?RTUNA | Sa?l?k

Prostate cancer treatment: hormone therapy I
Metastatic disease is the cause of nearly all prostate cancer-related death. Currently incurable, 5-year survival is 25%; 10% survive <6 months, while <10% survive >10 years. The mainstay of treatment is hormone therapy, with cytotoxic chemotherapy in reserve and novel treatments such as growth factor inhibitors, angiogenesis inhibitors, immunotherapy, and gene therapy in development. The concept of hormone therapy was realized in 1941 when Huggins and Hodges reported favourable acid and alkaline phosphatase responses in prostate cancer patients castrated or given oestrogens.

Hormone dependence of prostate cancer treatment
95% of circulating androgen, mainly testosterone, is produced by the Leydig cells of the testes under the influence of luteinizing hormone (LH). The anterior pituitary synthesises LH, stimulated by LH-releasing hormone (LH-RH) produced by the hypothalamus. The remaining 5% of circulating androgen is synthesized by the adrenal cortex from cholesterol, under the influence of pituitary ACTH. Testosterone is metabolized to the more potent dihydrotestosterone (DHT), by types 1 and 2 5-? reductase (5AR) enzymes. DHT binds to the androgen receptor, travels to the cell nucleus, and exerts its positive effect on cell growth and division. All prostate epithelial cells are dependent on androgens and fail to grow or undergo programmed cell death in their absence. Similarly, most previously untreated prostate cancer cells are dependent on androgens.

Androgen deprivation results in a reduction in PSA and clinical improvement in >70% of patients. However, most will still die within 5 years due to the development of androgen-independent growth. This is considered to be due to growth of androgen-independent cell clones rather than a de-differentiation of previously androgen-dependent cells. The mean time to disease progression after androgen deprivation is 14 months in men with metastatic disease.

Prognostic factors
Predictors of poor hormone therapy response include:
- metastatic lesions at presentation
- Elevated alkaline phosphatase at presentation
- Anaemia at presentation
- Poor performance status (level of activity) at presentation
- Low serum testosterone at presentation
- Failure of bone pain to improve within 3 months of treatment
- Failure of PSA to normalize within 6 months of treatment (conversely a PSA nadir (= lowest value) of <0.1ng/ml predicts a long-term response)

prostate cancer treatment : hormone therapy II
Mechanisms of androgen deprivation
- Surgical castration: bilateral orchidectomy
- Medical castration: luteinizing hormone-releasing hormone (LH-RH) agonists, oestrogens; also termed androgen ablation or androgen deprivation
- Anti-androgens (steroidal or non-steroidal): androgen receptor blockade at target cell
- Maximal androgen blockade (MAB): medical or surgical castration plus anti-androgen
- 5?? reductase inhibition (5ARI) with finasteride or dutasteride

Both forms of castration have equivalent efficacy, so patients should be given the choice. Oestrogens are no longer used first-line, due to the significant cardiovascular morbidity observed when they were the only alternative to orchidectomy. Anti-androgens alone are less effective in treating metastatic disease, but equivalent for non-metastatic disease. MAB has a theoretical advantage over castration in blocking the effects of the adrenal androgens, but significant clinical advantages have not been demonstrated in trial meta-analyses. 5ARIs are not licenced for the treatment of prostate cancer, but appear to have a role in prevention.

Bilateral orchidectomy ? prostate cancer treatment
A simple procedure, usually carried out under general anaesthesia. Through a midline scrotal incision, both testes may be accessed. The tunica albuginea of each testis is incised and the soft tissue content is removed, after which the capsule is closed. The epidiymes and testicular appendages are preserved. Post-operative complications include scrotal haematoma or infection (both rare). Serum testosterone falls within 8h to <0.2nmol/l.

LH-RH agonists ? prostate cancer treatment
Developed in the 1980s, giving patients an alternative to bilateral orchidectomy, with which they are clinically equivalent. They are given by subcutaneous or intramuscular injection, as monthly or 3-monthly depots. Examples include goserelin, triptorelin, and leuprorelin acetates. If the anterior pituitary is overwhelmed with an analogue of LH-releasing hormone (LH-RH), it switches off LH production, although serum testosterone rises in the first 14 days due to a surge of LH. This can result in? tumour flare , manifest in 20% patients with increased symptoms, including catastrophic spinal cord compression. To prevent this, cover with anti-androgens is recommended for a week before and two weeks after the first dose of LH-RH agonist.
An LH-RH antagonist is in development which should rapidly reduce serum testosterone.

Side-effects of bilateral orchidectomy and LH-RH agonists
- Loss of sexual interest (libido) and ED
- Hot flushes and sweats can be frequent and troublesome during work or social activity
- Weight gain
- Gynaecomastia
- Anaemia
- Cognitive (mood) changes
- Osteoporosis and pathological fracture secondary to osteoporosis may occur in patients on long-term (>5 years) treatment

Anti-androgens ? prostate cancer treatment
These are administered as tablets. Examples include bicalutamide (150mg daily as monotherapy; 50mg daily for MAB, in combination with LH-RH analogues or orchidectomy), flutamide, and cyproterone acetate. The first two raise the serum testosterone slightly, so sexual interest and performance should be maintained, although many such patients have pre-existing ED due to the advancing disease. Side-effects include frequent gynaecomastia, breast tenderness, and occasional liver dysfunction; flutamide also causes frequent GI upset. At its full dose of 100mg tds cyproterone acetate may cause reversible dyspnoea; it may be used at 50mg bd for treatment of castration-induced hot flushes.

Management of advanced prostate cancer: hormone therapy III
Monitoring prostate cancer treatment
Typically, patients will have baseline PSA, full blood count, renal and liver function tests, a renal ultrasound, and a bone scan. The PSA is repeated after 3 months, 6 months, and 6-monthly thereafter until it rises. Liver function is checked 3-monthly if anti-androgen monotherapy is used. Renal function should be checked on disease progression, and bone imaging if clinically indicated.
While PSA is very useful as a marker for response and progression, 15% of patients show clinical progression without PSA rise. This may occur in anaplastic tumours that fail to express PSA.
Advice on exercise, diet, and treatment of erectile dysfunction is often sought by patients during treatment.

Early versus delayed hormone therapy
Traditionally, hormone therapy was reserved for patients with symptomatic metastatic disease. Arguments against early hormone therapy revolve around its side-effects and cost.
However, studies of patients with locally advanced and metastatic disease have demonstrated slower disease progression and reduced morbidity when treated with androgen deprivation early (i.e. before the onset of symptoms). Improved survival has also been reported in patients without bone metastases but including node-positive disease, when treated immediately.
Trials have also demonstrated slower disease progression in patients given bicalutamide 150mg daily (compared with placebo) for 2 years after treatment of high-risk, clinically localized prostate cancer with RP or RT. This benefit is not seen in patients managed by watchful waiting.

Intermittent hormone therapy
The potential advantages of stopping hormone therapy when the disease has remitted, then re-starting it when the PSA has risen again are the reduced side-effects and cost. However, there are no randomized trials yet demonstrating survival equivalence or advantage. None of the LH-RH analogues or anti-androgens are licensed for intermittent therapy. Moreover, it can take up to 6 months after stopping treatment for the serum testosterone to recover, hence side-effects may persist into the off-treatment periods.

prostate cancer treatment: androgen-independent disease
Second-line hormone therapy
When the PSA rises from its lowest (nadir) value, or if symptomatic progression occurs despite a favourable biochemical response to first-line hormone therapy, the disease has entered its androgen-independent phase. In these circumstances, further treatment is usually considered. Most patients receiving anti-androgen monotherapy respond after switching to androgen ablation (orchidectomy or LH-RH analogue). If there is relapse during androgen ablation, 25% respond by adding an anti-androgen (e.g. bicalutamide 50mg daily) to establish maximal androgen blockade (MAB). If MAB was used from initiation of hormone therapy, withdrawal of the anti-androgen paradoxically elicits a favourable response in 25% of patients.
A further rise in PSA may require third-line hormonal therapy such as the addition of oestrogens or corticosteroids. For example, diethylstilboestrol 1mg daily with 75mg aspirin for thromboembolic prophylaxis elicits a response in up to 60% of these patients. The mean duration of response is 4 months.
The prognostic factors for survival with androgen-independent disease are identical to the factors predicting response to hormone therapy, plus time from initiation of hormone therapy to initiation of chemotherapy and visceral metastasis status.

Cytotoxic chemotherapy
Systemic chemotherapy is offered to appropriate patients with androgen-independent metastatic disease, by the medical oncologist. Men with low-volume disease who have failed radical local treatment and hormone therapy are also candidates for chemotherapy. Elderly, frail, and infirm patients with significant bone disease, renal impairment, haematological and clotting abnormalities are unsuitable. Correction of renal and bone marrow dysfunction is necessary prior to treatment.

Symptom palliation
Symptom improvements are reported with cytotoxic chemotherapy. In a randomized trial of mitoxantrone plus prednisolone versus prednisolone alone, 29% in the combination group experienced a reduction in pain and analgesic use compared with 12% in the prednisolone alone group. PSA response did not predict palliative response. In another study, docetaxel plus prednisolone produced a pain reduction in 35% compared to 22% of patients given mitoxantrone and prednisolone, resulting in improved quality of life scores.

Cancer control
There are several reports of single-agent chemotherapy in the PSA era, most defining response as >50% decrease in PSA. Responses are reported in 20 ? 40% of patients with haematological toxicity (especially neutropenia) for most agents. Better responses (up to 75%) reported with newer combination regimes (e.g. estramustine phosphate plus docetaxel) but with greater toxicity. The median survival following chemotherapy ranges from 24 to 44 weeks. Results of two randomized studies comparing docetaxel with mitoxantrone plus prednisolone have shown a 2.4 ? 3 months? median survival advantage in favour of docetaxel.

New-home prices rise, but sales slip

By Reuters

Sales of new homes fell in February, but a jump in prices to their highest level in eight months kept hopes alive of a recovery in the housing market.

The Commerce Department said on Friday sales slipped 1.6 percent to a seasonally adjusted rate of 313,000 units. January's sales pace was revised down to 318,000 units from the previously reported 321,000 units.

Sales for November and December were revised up a bit.

Economists polled by Reuters had forecast sales at a 325,000-unit rate in February. Compared to February last year, new home sales were up 11.4 percent.

The median price for a new home rose 8.3 percent to $233,700, the highest level since June. Compared to February last year, the median price was up 6.2 percent.

The report, which rounded off a week of mixed housing data, followed a similar pattern seen in the market for used homes. Home resales fell in February, but prices rose from a year earlier. Housing starts slipped, while permits for home building approached a 3-1/2 year high in February.

The housing market continues to be hobbled by an oversupply of used homes on the market - especially from foreclosures, many of which sell well below their market value.

The inventory of new homes on the market was unchanged at a record low 150,000 units last month. At February's sales pace it would take 5.8 months to clear the houses from the market, up from 5.7 months in January.

New home sales last month surged in the Northeast and West, but slumped in the South and Midwest. New home sales account for about 7 percent of the overall housing market and face stiff competition from the used home segment despite low levels of stock.

Senior Year Spring Break ? Israel? ? BUSINESS, INNOVATION ...

Spring Break 2012!

I imagine my spring break experience is very different from that of most of my friends. While they enjoyed the beaches of Mexico and Miami, I spent my time going in and out of offices. I exchanged bathing suits for business casual, a tan for knowledge. You may be asking yourself why a senior like me chose to spend her last spring break on an educational trip, traveling with her teacher and other students two to three years younger. Let me tell you.

Although not my first time in Israel (I?ve been with Taglit as well as my family), I?m experiencing it like I never have before. On my other trips, I?ve prayed at the Wall in Jerusalem, visited a winery in the Golan Heights, climbed Masada, floated in the Dead Sea, enjoyed the nightlife of Tel Aviv, and relaxed on the beaches of Eilat. I could keep going, but the list is exhaustive. I knew about Israeli culture as well as the the geopolitical issues that surround the country, but until I took this course, I was unfamiliar with the innovative and entrepreneurial side of Israel, the side they neglected to show on my previous visits.

Did you know that aside from the United States and China, Israel has the highest number of publicly traded companies on the various exchanges in New York? That close to 300 foreign companies have research and development centers in Israel? That the number of ?Israeli start ups per year are on par with that of all of Europe? I didn?t, at least not until I began this course in January 2012. To benefit both Israel and the United States, I believe that more people need to be aware of all of the unbelievable innovations that are currently occurring in Israel. You can bet that I will be sharing my experience with my friends, family, teachers, employer, and pretty much anyone else who is willing to listen.

This class and this trip to Israel have influenced my life for the better. My understanding of Israel and its economy have grown exponentially. My own career goals have become more defined. In one week, I?ve met some of the most amazing, inspiring, brightest people I have ever met. Do I regret my spring break decision? Not at all. I only wish that I had read Start Up Nation by Saul Singer and Dan Senor two and a half years ago when my parents had asked me to, that I had taken this course one or two years earlier.

Have I and the rest of my class convinced you of how amazing this country is and how vital an understanding of all that is occurring in Israel is. If so, spread the word. Read Start Up Nation. Visit Israel. Do what you can to understand, to make a difference.

Henderson: Transparency on Employment Data is Like Cancer Treatment

The Legal Whiteboard, Transparency on Employment Data is Like Cancer Treatment, by WIlliam D. Henderson (Indiana-Bloomington):

Over the last several months, I have reluctantly concluded that law school employment transparency is a lot like cancer treatment:? it can beat back symptoms and buy time, but it won't necessarily cure the disease.?

Over the last 18 months, three separate ABA groups -- the Questionnaire Committee, Standards Review Committee, and the Council on Legal Education -- have given sincere and focused attention to the law school employment controversy.? Frankly, I am in awe of the breadth and depth what they have accomplished.? ...

With the ABA getting its house in order, and yesterday's dismissal of the alleged deceptive employment data against New York Law School (albeit there are cases pending against other law schools under different consumer protection laws), it is possible to begin conceiving of US legal education in a new post-scandal era. This is all very good.

Going back to the cancer metaphor, however, the ABA industry-level transparency efforts are going to beat back a lot of symptoms of what ails us.? But they won't provide a permanent cure.? Further, the relief will be, at best, temporary. Going forward, every ABA-accredited law school needs to seek out additional aggressive treatment in order to increase our odds of beating back the long term threat.

On this score, we legal educators cannot lose sight of the fact that the lack of transparency was precipitated by structural problems in legal education that aren't going away:

  1. Our costs are too high
  2. The market for traditional legal jobs is stagnant and likely in long term decline
  3. There is industry overcapacity (50,000+ 1L seats per year)
  4. Public subsidies are going away
  5. Near total financial dependence on loans from the US Dept. of Education
  6. Law is on the precipice of a radical information revolution led by technology, knowledge management, and process engineering
  7. Tenured faculty control hiring and curriculum and have a limited appetite for retooling
  8. We law professors don't understand that we are running a business
  9. Our rankings are based on high costs and admissions sorting
  10. Thus, based on #9, there is no market reward for innovation or value-add in legal education.? In fact, the concept--that education can trump sorting--still needs to be proven.

In the short to medium term, industry-level transparency will have two effects that pull in opposite directions. First, the legal education industry, at least at the ABA self-regulation level, will have clean hands.? That really matters.? But second, and pulling in the opposite direction, transparency will give rise to a whole new rankings industry that will rival and potentially supplant US News.

Why? Because law students don't really care about rankings per se -- instead, they care about the number and quality of employment options created by their law school investment.? In the US News rankings, top law schools rankings are highly correlated with a multitude of wonderful options.? But in the new transparency era, it will be possible to use hard data to make more precise decisions for all the other law schools. ...

To be clear, transparency will not create law jobs for law school graduates.? Instead, it will reveal in minute detail the value proposition of every ABA accredited law school. Everything needed for the new Employment Transparency Rankings will be in the public domain. ...

For those of us that accept change as the one bankable constant, change is less a threat than an opportunity.? Over the next five to ten years, maybe slightly longer, a more sustainable Post-Langdellian business model for legal education will emerge.? This new model will likely place a higher emphasis on communication, collaboration, and problem solving, which are the skills needed to price, allocate and manage risk.? Winning a case in court is only a sliver of the calculus.? Technology and new pedagogy will pack a much better education into three years.?? At least some scholarship will be highly applied.? And at the best schools, teaching, service and scholarship will merge, and the most valuable faculty will be less ivory tower.?? It will be an exciting place for students, professors and alumni.

If we pursue the right treatments, we can survive to help create and experience this new era.

Although the comparison makes sense, it would be wise not to go there. Comparing the plight of law student/recent graduate versus cancer patients/treatment will certainly offend quite a few people, even if you "reluctantly conclude" such.

FCC proposal could help Dish wireless plan

WASHINGTON (Reuters) - Communications regulators proposed on Wednesday a more flexible use of satellite airwaves that could help Dish Network Corp launch a wireless cellular network.

The Federal Communications Commission said it would develop rules to make a block of mobile satellite spectrum available for mobile broadband use.

The proposal is in line with the agency's push to free up more airwaves to meet the booming demand for mobile devices like Apple Inc's iPad tablet and Google Inc's suite of Android-powered smartphones.

Dish, the second-largest satellite TV provider in the United States, is seeking to diversify its business beyond pay TV. The company spent more than $3 billion on spectrum it bought from DBSD and Terrestar last year.

The FCC earlier in the month approved Dish's license to acquire the spectrum, but denied the company's request for a waiver to allow it to build a terrestrial wireless network.

Instead the agency opted to initiate a rule-making process, a potentially lengthy process that could hurt the value of the satellite television company's newly acquired wireless assets.

The agency on Wednesday signaled support for Dish's wireless plans. FCC Chairman Julius Genachowski said at the agency's open meeting that he aimed to quickly close this proceeding and make the satellite spectrum available for other uses.

The FCC came under fire from lawmakers for granting a waiver in January 2011 to Philip Falcone's wireless start-up LightSquared LP to allow it to offer cellular service to traditional mobile phones.

The agency has since proposed stripping LightSquared of authority it had previously given the firm to use its satellite spectrum for a ground-based cellular network due to interference with the Global Positioning System used by airlines, the military and others.

Analysts say Dish's wireless network would not be expected to face the same interference problems as it would be on a different spectrum band.

"The question is how the FCC will go about making this change, particularly the requirements it could impose on Dish," analysts at Stifel Nicolaus said in a research note. "There may be some interference issues, but they appear nothing like those faced by LightSquared."

The FCC's proposal on Wednesday calls for protections from harmful interference for incumbent users of the spectrum band and seeks input on any interference concerns from licensees in nearby bands.

Dish could not immediately be reached for comment.

Dish Chairman Charlie Ergen said on a conference call in late February that if Dish were not granted a waiver, or if there were a delay with a decision, it might have to look at alternatives for its wireless assets, including writing down their value.

Cellular service is much more valuable than satellite services, which are costly and used by fewer customers.

In afternoon Nasdaq trading, Dish shares were up 82 cents or 2.56 percent to $32.02.

Tornado-hit Ind. school wins Lady Antebellum show

INDIANAPOLIS (AP) ? A southern Indiana high school wrecked by tornadoes won a free concert by country music stars Lady Antebellum on Tuesday thanks to a rival school that, along with students in other states, advocated on the battered school's behalf in an online contest.

Schools from as far away as northern Wisconsin submitted YouTube videos urging the Grammy-winning group to choose Henryville High School in the band's "Own the Night" contest, which offered the winning school a concert at its prom. Henryville's schools were heavily damaged when powerful tornadoes ripped through the region earlier this month, killing 13 people.

The winning video was entered by students at Silver Creek High School in nearby Sellersburg, Ind., a longtime sports rival of Henryville High. They spent two days filming in Henryville, interviewing residents and getting footage of the devastation. Henryville also got video support form a southern Illinois community that suffered a fatal tornado in February.

"It meant a lot to us and made a lot of people cry. Knowing there's that many people out there that cared to give it to us instead of their own prom," said 17-year-old Henryville junior Daniele Kats, adding that word spread quickly on Facebook about Lady Antebellum's choosing her school.

"It's gonna be awesome," she said Tuesday evening.

Lady Antebellum said the band was touched by Henryville's "story, resilience and unity following devastating tornadoes." Because of a scheduling conflict, the trio won't be able to perform at Henryville's prom on April 27, so a concert will be held for juniors and seniors in nearby Louisville, Ky., on May 16, followed by a benefit for the community.

Lady Antebellum singer Charles Kelley said Henryville students shouldn't be disappointed that the band won't be able to visit their community.

"Trust me, we have something even bigger in store," Kelley said in the band's video announcing the win. Fellow singer Hillary Scott added: "See you soon, Henryville!"

The trio, rounded out by Dave Haywood, won best country album at this year's Grammy Awards for "Own the Night," and took home several Grammys last year, including record and song of the year for "Need You Now." Details about its Louisville concert will be released soon.

Video entries supporting Henryville also came from D.C. Everest Senior High School in Weston, Wis., and from Harrisburg, Ill., where a tornado that struck Feb. 29 killed seven people.

Harrisburg students said that despite their community's loss, they decided to back Henryville's prom bid.

Henryville art teacher Amy Fischmer, the prom committee's co-chairwoman, said her students were "grateful and happy" of the outpouring of support on the school's behalf following the devastating storms on March 2.

"That day was a tragedy, but they're just rallying and making the most of it and just enjoying life," she said. "For the winning video to be one that was entered on their behalf from another school makes it mean so much more. It kind of reaffirms your hope in humanity."

Classes for Henryville high school students will resume on April 2 in a nearby community. The prom, which is expecting about 200 students, also will be held at another site.

Mary Beth Coffman, Silver Creek's mass media teacher, recruited three of her students to be the video's stars and helped them gather interviews and footage. The video ends with a student standing in a field before dozens of classmates, saying, "Lady A, even if we don't win the contest, we're still going to own the night anyway" before they begin chanting "HHS! HHS!"

"I've been jumping up and down and screaming by myself," Coffman said. "I'm so excited to be part of something that's going to be so special."

Coke linked to cancer: Yet another reason to avoid soda | NJ.com

Coke has long been criticized for its high levels of sugar and caffeine, and can for the most part be judged as an unhealthy drink. The drink, along with other sodas, has been linked with causing obesity, loss of bone density and teeth corrosion. Yet research has recently revealed that the product contains an ingredient that could also be responsible for causing cancer.

4-methylimidazole, or 4-MI, is an ingredient in the caramel coloring used for coke soda products. Researchers found that the chemical has proven to be carcinogenic in animals. They produced the following toxicology results: ? 4-methylimidazole (4-MI) causes lung tumors in male and female mice and mononuclear cell leukemia in female rats. Other NTP studies found that 2-methylimidazole caused liver tumors in male and female mice, thyroid tumors in male mice, and precancerous thyroid changes in female mice. In rats, 4-MI caused an increased rate of tumors in thyroid follicular cells in females and an increased rate of hyperplasia in thyroid follicular cells in males.?

The question is does Coca-Cola and Pepsi, two of the world?s most famous soda brands, contain enough of the chemical to pose a serious threat to the health of humans? 4-MI was recently added to California?s Proposition 65, otherwise known as the Safe Drinking Water and Toxic Enforcement Act of 1986. The law limits the amount of 4-MI to 29 micrograms from a single product per day. Any products that contain an amount higher than that will require a warning label that it contains a carcinogen. The Center for Science in the Public Interest (CSPI) found that a 12oz coke contains as much as 142 micrograms of 4-MI. Thus Coca-Cola and Pepsi have found themselves scrambling to change their formula; a procedure that they claim will not change the taste or the quality of their beverage.

The U.S. Food and Drug Administration heard the claims of CSPI, and still deemed the drinks safe. On behalf of the FDA one spokesperson said someone would have to consume "well over a thousand cans of soda a day to reach the doses administered in the studies that have shown links to cancer in rodents". Yet CSPI still stands firm behind its claims, estimating that as many as 15,000 cancers in the US can be linked to the presence of 4-MI in Coca-Cola and Pepsi products. The threat of cancer is yet another reason why people should consume soda products in moderation.
