New York Updates Tax Policies for Out-of-State Businesses Helping Hurricane Clean-Up

The New York Department of Taxation and Finance has updated its policies regarding individuals and businesses temporarily in New York because of Hurricane Sandy. An audit/compliance policy is now in effect.?

Sales Tax Requirements

Under the audit/compliance policy:

?Any business that sells taxable personal property or provides taxable services in New York State must register as a sales tax vendor and collect and remit sales tax.??

This policy applies no matter how long a company does business in the state of New York.

All vendors must register with the Tax Department and obtain a Certificate of Authority, which allows vendors to ?collect tax on ? taxable sales and to issue and accept most New York State sales tax exemption certificates.?

Vendors who are unable to register online should contact the Sales Tax Information Center at the Department of Taxation, at 518-485-2889.

Products Subject to Sales Tax

New York State sales tax applies to tangible personal property, defined as ?any kind of physical personal property that has a material existence ? (something you can see and touch)? that is sold by businesses. These include, but are not limited to:

• Furniture, appliances, and light fixtures;
• Computers;
• Motor vehicles;
• Candy and confections;
• Bottled water;
• Cosmetics and toiletries;
• Animals (for example, dogs, cats, or pet birds);
• Trees, shrubs, and seeds;
• Building materials.

Services Subject to Sales Tax

Many services are also subject to New York State sales tax. These include, but are not limited to:

• Trash/debris removal;
• Tree removal;
• Repairing damaged windows, roofing, siding, drywall, electrical wiring; and
• Appliance repair.

Out-of-state contractors and repair people should follow the sales tax guidance for capital improvements and taxable repair/maintenance services.

Sales Tax Returns

Sales tax returns must be filed with the Department of Taxation and Finance. This may be done through the department?s Online Services, which is both quick and free. A final sales tax return must be filed once an ?out-of-state company is no longer conducting business in New York State.?

Disaster Related Assistance for Sales Tax?

The Federal Emergency Management Agency (FEMA) and the Red Cross are providing vouchers that allow ?individuals to obtain specifically identifiable goods and services (e.g. hotel accommodations).? Items purchased with these vouchers are not subject to sales tax. Any purchased taxable products and services not covered by the voucher are subject to sales tax.

Other Tax Policies

Under this policy, and in specific situations (listed on the website) the Department of Taxation and Finance will NOT assess:

• Corporate franchise taxes;
• Withholding taxes;
• Personal income taxes;
• Any penalty or interest related to the above taxes.

NASA dangles big, secret Mars discovery, but we don't want to wait

As Curiosity prepares for Thanksgiving on Mars, rover fans have been left hanging about a discovery from the Red Planet that a NASA official has billed as a big one.

Just you wait, NASA says.

Not everyone wants to. Curiosity's Facebook page had one early-morning comment from a fan: "WHAT IS IT?!?!"? Mars watchers were expressing the same sentiments on Twitter.

NPR stirred things up Tuesday with a report in which John Grotzinger, principal investigator for the rover mission, called the news a discovery for the history books: "This data is ... looking really good," he said.? The scientist told NPR it would be several weeks before NASA had anything to say. Researchers are being very careful to make sure they get it right before they blab.

Early-morning e-mails to contacts by the Los Angeles Times failed to unearth anyone willing to squeal.? Media reports are full of speculation. Did Curiosity "sniff signs of life?" asks Popsci.com.

But it looks like we'll just have to wait. We do know that the discovery was made by SAM, the Sample Analysis at Mars suite of three instruments. As The Times' Amina Khan reported this month, SAM analyzes both soil and gases.

"Think of it like a Swiss Army knife," SAM co-investigator Laurie Leshin told The Times. "It's a beautifully integrated set of tools that can do many jobs ... and of course it's right there in Curiosity's pocket."

Scientists have been hoping to detect methane, which would indicate that there were once living things on Mars. And at one point it appeared that SAM had in fact found methane, according to NPR. But an announcement of that news was held up and, in the end, never came out because a second measurement showed no methane. That experience helps explain NASA's caution in discussing the latest finding.

Meanwhile, Curiosity continues to roll on Mars, although it will take a holiday break.? According to NASA, the rover had another first on Sunday, when it completed a touch-and-go inspection of one rock.

"We have done touches before, and we've done goes before, but this is our first 'touch-and-go' on the same day," Curiosity Mission Manager Michael Watkins said in a news release.

Over Thanksgiving, Curiosity's Mast Camera will be used to scout? possible routes and targets, the space agency said.? Next up: Choose a rock for the first use of the rover's hammering drill, to collect samples of rock powder.

Bernanke's "cliff" comments break two-day rally

NEW YORK (Reuters) - Wall Street halted its two-day rally on Tuesday, after Federal Reserve Chairman Ben Bernanke said the central bank lacks tools to cushion the economy from the impact of the "fiscal cliff."

The day's biggest disappointment was Hewlett-Packard Co shares , which sank to a 10-year low after the computer and printer maker swung to a fourth-quarter loss and announced a $5 billion charge related to "accounting improprieties." The stock slid 12 percent to close at $11.71.

Bernanke, in comments before the Economic Club of New York, said the Fed does not have the ability to offset the damage that would result if politicians fail to strike a deal to prevent a series of mandatory tax increases and spending cuts scheduled to go into effect early next year.

The statement caused a downdraft in the market, though the equity market cut most of its losses before the end of the day.

"This is a more realistic and pragmatic picture of where we are, compared to what we've been hearing for the past couple of days from politicians that are mostly PR stunts," said James Dailey, portfolio manager at TEAM Asset Strategy Fund in Harrisburg, Pennsylvania.

Stocks had rallied for the last two sessions after Washington politicians sounded an encouraging note that a deal to avoid the U.S. fiscal cliff could be reached. The gains followed two weeks of sharp losses that pushed the S&P 500 down through the 200-day moving average, a key benchmark of the market's long-term trend.

The S&P ended Tuesday near that level, which was 1,382.68.

The Dow Jones industrial average <.dji> slipped 7.45 points, or 0.06 percent, to 12,788.51 at the close. But the Standard & Poor's 500 Index <.spx> edged up 0.93 of a point, or 0.07 percent, to finish at 1,387.82. The Nasdaq Composite Index <.ixic> inched up 0.61 of a point, or 0.02 percent, to close at 2,916.68.

Dow component HP said it took an $8.8 billion charge in the quarter, with $5 billion related to its acquisition of software firm Autonomy, citing "serious accounting improprieties." HP's market value is now just $23 billion, compared with $100 billion just two years ago.

Best Buy Co shares fell 13 percent to $11.96 after the consumer electronics retailer reported a net loss of $13 million for the third quarter on weaker-than-expected sales at its established stores.

Another factor weighing on stocks was Moody's Investors Service's reduction of France's sovereign rating by one notch to Aa1 after the market's close on Monday. Moody's cited an uncertain fiscal outlook as a result of the weakening economy.

"This brings forward a whole new set of problems to the euro -zone issue. When the lifeguards, in this case, Germany and France, are in trouble, when they need to save people like Greece and Spain, that could be a big concern," Dailey said.

Earlier, data showed U.S. housing starts rose to their highest rate in more than four years in October, suggesting the housing market recovery was picking up momentum, even though permits for future construction fell.

An index of housing-related shares <.hgx> shot up 2.5 percent.

Volume was roughly 5.6 billion shares on the New York Stock Exchange, the Nasdaq and the NYSE MKT, compared with the year-to-date average daily closing volume of around 6.5 billion.

Advancers outnumbers decliners on the NYSE by a ratio of about 4 to 3. On Nasdaq, the opposite trend took hold, with about 13 stocks falling for every 12 that rose.

US retailer Toys ?R? Us has launched its own online shopping site in China (at toysrus.com.cn) in a bid to tap into the country?s fast-expanding middle-income consumers. The company began its global online push in 2009, seeing double-digit growth and generating $1 billion in online sales last year.

Toys ?R? Us has 30 brick-and-mortar stores across 21 cities in mainland China already, so its new site is a sign that it wants to tackle China?s heated e-commerce market as well. In today?s announcement, the retailer outlines its expectations for the Chinese site:

[Company] e-commerce sales will account for nearly 10 percent of retail sales in China by or shortly after 2015. The launch of e-commerce capabilities to better serve Chinese consumers is an integral part of the company?s continued strategy for growth over the long term.

In addition to today?s online launch in China, Toys ?R? Us also announced the development of mobile-optimized sites and apps in 11 markets around the world. In Asia, that affects only Japan.

But Toys ?R? Us might find it hard to go solo with its online shopping efforts, as it hasn?t opted to follow many other brands in also setting up virtual storefronts on some of China?s top e-commerce sites, such as Tmall, QQ Buy, or 360Buy. Those B2C e-tailing behemoths drive insane amounts of traffic, while the standalone Toys ?R? Us will be reliant on being found by search engines, or on consumers? brand loyalty. However, as shown by the failure of other big retailers and web companies in China ? such as Best Buy and eBay ? you can?t rely on a global brand-name to bring in customers, and you really have to localize and adapt very well for the local market.

Speaking of eBay, it made a quiet ? and surprisingly fashion-oriented ? return to the China market earlier this month.
